These Terms and Conditions (the “Terms”) govern access to and use of the Website, as well as the purchase of products offered by JerseyWare (“we,” “us,” “our”). By using the Website or placing an order, the user (“you,” the “Customer”) accepts these Terms.

1. Key Definitions

  • Products: Jerseys and sportswear, customized or not.
  • Order: A purchase request placed by the Customer through the Website.

2. Conditions of Use of the Website

  • You must be at least 18 years old or use the Website under supervision of a legal guardian.
  • You agree to provide accurate information and to keep your login credentials confidential.
  • Prohibited uses include: fraudulent use of the Website, uploading unlawful content, infringing intellectual property rights, reverse engineering, or unauthorized automated use.

3. Product Information and Availability

  • We make every effort to display descriptions, sizes, and colors accurately; however, variations may occur due to lighting, display settings, or production batches.
  • Availability is subject to stock. If a Product is unavailable after your order, we will notify you and you may exchange, wait, or receive a full refund.

4. Prices, Currencies, and Taxes

  • Prices are shown in [MXN/USD/EUR] based on multi-currency settings or geolocation.
  • Unless otherwise indicated at checkout, prices do not include duties, import taxes, or other local charges applicable in your country.
  • We reserve the right to correct pricing errors before accepting an order. If a correction is made, you may cancel at no cost.

5. Payments and Security

  • We accept: [Stripe (cards), PayPal, Mercado Pago, etc.]
  • All transactions are processed through certified gateways. We may cancel/hold orders for fraud prevention or additional verification.

6. Order Process and Acceptance

  • You place the order and receive a confirmation of receipt by email.
  • Acceptance of the order occurs when we issue the shipping confirmation with a tracking number.
  • If we cannot process your order (lack of availability, failed verification, etc.), we will refund you in full.

7. International Shipping

  • Estimated timeframes: [5–7] business days for processing + [15–20] for international transit. Estimates may vary due to customs, peak season, or force majeure.
  • Tracking: We will send tracking information once provided by the carrier.
  • Risk of loss: Transfers to the Customer upon delivery at the address provided. Visible damage must be noted upon signature and reported in accordance with Section 9.

8. Customizations and Customer Content

  • If you request a name/number or other customization, you warrant that you have the right to use that content and that it does not violate any laws or third-party rights.
  • Customized products are not eligible for returns or exchanges, except in case of manufacturing defect or our error.

9. Returns, Exchanges, and Refunds

General window:

  • Non-customized: right to return within [14/30] calendar days from delivery, unused and with original packaging/tags.
  • Customized: only for manufacturing defect or error (report within 7 days of delivery).

Process (RMA):

  1. Request an RMA at Jerseywareoficial@gmail.com with order number, photos, and reason.
  2. We will send return instructions (do not ship back to the manufacturer).
  3. Once received and inspected, we issue a refund to the original payment method, less return shipping costs and, if applicable, a restocking fee [0–15%].

Sizes: We offer size exchanges for non-customized items (subject to availability). Outbound/return shipping costs are borne by the Customer unless the error is ours.

Damaged/defective product: You must report within 7 days with photo evidence of the damage/defect and packaging. If confirmed, we will replace or refund at no cost to you.

10. Warranty

  • Limited warranty against manufacturing defects for [30/90] days from delivery. Does not cover normal wear and tear, misuse, improper washing, or accidental damage.

11. Intellectual Property

  • All Website content (designs, texts, images, our own logos) belongs to JerseyWare or is used under license.
  • Team/league names and logos are the property of their respective owners. Their appearance does not imply any relationship or sponsorship.
  • Reproduction or unauthorized use of any content is prohibited.

12. Promotions, Coupons, and Programs

  • Coupons are not cumulative unless stated. They may have expiration dates, limits, and exclusions (e.g., already discounted or customized products).
  • We may modify or cancel promotions without prior notice in cases of obvious error or abuse.

13. Liability

  • To the maximum extent permitted by law, our total liability to the Customer for any claim related to an order will not exceed the amount actually paid for that order.
  • We are not liable for delays caused by customs, strikes, logistics disruptions, or force majeure events.
  • Nothing herein limits the non-waivable consumer rights in your country of residence.

14. Data Protection and Cookies

  • The processing of your data is governed by our Privacy Policy, and the use of cookies by our Cookie Notice, both available on the Website.

15. Customer Account

  • You are responsible for keeping your credentials confidential and for all activity under your account.
  • We may suspend or terminate accounts that violate these Terms or due to suspicious activity.

16. Changes to the Terms

  • We may update these Terms at any time. The current version will be published on the Website with its last-updated date. Changes apply to future purchases.
